Elmer Sierra, et. al. v. Dorel Juvenile Group
Partner Jaime Saenz, along with National Counsel Wally Greenough and Rachel Remke, defended Dorel Juvenile Group in a personal injury lawsuit filed on behalf of Elmer Sierra and his wife Norma Sierra. The lawsuit arose from injuries sustained by Mr. Sierra on October 30, 2010, when he fell off a ladder designed and distributed by Dorel Juvenile Group. Mr. and Ms. Sierra claimed that the subject multi-purpose ladder was defective by design and manufacture, which they alleged were a producing cause of Mr. Sierra’s injuries. Specifically, Mr. Sierra sustained a comminuted fracture of the fibula and tibia and further sustained a tibial plateau fracture. Mr. Sierra suffered from compartment syndrome and this condition required more lengthy and comprehensive medical treatment. Mr. Sierra further sought damages for loss of profits from a water business and other personal injury damages allowed under Texas law. Trial began with jury selection on July 21, 2015 and the trial concluded on July 24, 2015. The jury returned a defense verdict.
