Jaime A. Saenz and Norton A. (Trey) Colvin, III of the firm were two of four counsel defending Ford Motor Company in this litigation involving Plaintiffs’ claim that the driver’s side door latch on decedent’s 1998 Ford F-150 released during his collision with a Pool Company semi-tractor driven by Defendant Richard Garza. The accident occurred approximately 6.4 miles north of Los Arrierros on U.S. Highway 83 when according to the Texas Peace Officer’s Accident Report, Lopez’s vehicle veered out of its lane into the opposite lane and entered the path of the semi. Plaintiffs contended that Lopez was ejected through a driver’s side door opening allegedly created by a defective door latch. Ford contended that the door latch had not unlatched, that Lopez, who was unrestrained, was instead ejected out the backlight of the pick-up, and that pursuant to principles of comparative negligence, he should be held responsible for the accident. Prior to trial, Plaintiffs resolved their claims against Pool, Donnelly, and Gonzalez (all other defendants). Trial began with jury selection on January 17, 2007, with the evidence being submitted in one-week shifts, as the Judge rode circuit through Starr, Jim Hogg, and Duval Counties. Trial concluded with a defense verdict received on the evening of April 13, 2007.
