Luis Alberto Rodriguez v. Perspectiva Group, Inc.
Partner Jaime A. Saenz and Associate Nikki Chargois-Allen defended R. M. Personnel, Inc. in a case involving its employee, Luis Alberto Rodriguez, who fell down an elevator shaft. R. M. Personnel, Inc. is a temporary employment agency based in El Paso, Texas. R. M. Personnel, Inc. had hired Mr. Rodriguez and sent him as a general laborer to a construction site owned by Perspectiva Group, Inc. At the construction site, there was a penthouse roof on the top of the elevator shaft that had been constructed by Sunsets West, Inc. The general contractor for Perspectiva Group, Inc. sent Mr. Rodriguez up to the roof where he fell 50 feet from a penthouse roof opening. . Mr. Rodriguez suffered catastrophic and permanent injuries. He sued the property owner/general contractor, the subcontractor who worked on the penthouse roof, and his employer, R. M. Personnel, Inc. A trial on the merits began on March 16, 2015, and concluded with the return of the jury verdict on April 1, 2015. The jury returned a total verdict for the Plaintiff in the amount of $20,500,000.00 . The verdict was mixed on negligence, with the jury assessing 61% responsibility on Perspectiva Group, Inc., 11% each on the Plaintiff and Sunsets West, and 17% on R. M. Personnel, Inc. The verdict is currently on appeal.
